These Terms of Service ("Terms") govern your use of ParkTrooper LLC's parking facilities, website (parktrooper.com), and related services. By using our services or submitting a parking application, you agree to these Terms. Please read them carefully.

1. Services Provided

ParkTrooper LLC ("ParkTrooper," "we," "us," or "our") provides surface parking lot management services in the Austin, Texas metro area, including hourly parking, daily parking, monthly reserved parking contracts, and commercial lot management partnerships. Specific terms for each service type are described in separate agreements or rate schedules provided at the time of service.

2. Monthly Parking Contracts

Monthly parking is governed by a separate Monthly Parking Contract signed between ParkTrooper and the customer. Key terms include:

• Reservation: A monthly parking contract entitles the holder to use a designated space (or any available space within the assigned lot, as specified in the contract) during the contract period.
• Payment: Monthly fees are due on the date specified in your contract. Late payments may result in suspension of access and, if unpaid, termination of the contract.
• Cancellation: Either party may cancel the monthly contract with written notice as specified in the signed agreement. Prepaid amounts are non-refundable except as required by applicable law.
• Transferability: Monthly parking contracts are non-transferable and apply only to the vehicle(s) listed in the contract.
• Hang Tags / Credentials: Monthly parkers will receive a hang tag, decal, or digital permit. Lost credentials must be reported immediately to support@parktrooper.com. Replacement fees may apply.

3. Use of Parking Facilities

By using any ParkTrooper-managed parking facility, you agree to:

• Park only in designated spaces and comply with all posted signage
• Not block fire lanes, access roads, driveways, or other vehicles
• Not use the lot for storage, overnight camping, or commercial activity
• Comply with all applicable traffic laws and posted speed limits within the facility
• Remove your vehicle promptly when your parking period expires
• Not damage lot equipment, signage, lighting, or pavement markings

4. Towing and Enforcement

ParkTrooper-managed lots are actively enforced. Vehicles that violate posted rules — including unauthorized parking, expired permits, or blocking — may be towed at the vehicle owner's expense without further notice. Towing is performed by a licensed TDLR-authorized towing company as required by Texas Occupations Code Chapter 2308. To locate a towed vehicle, contact the towing company listed on the lot's posted towing notice signs.

ParkTrooper is not responsible for costs, damages, or inconvenience arising from the lawful towing of a vehicle that violated posted parking rules.

5. Limitation of Liability

IMPORTANT — PLEASE READ: Vehicles are parked in ParkTrooper facilities at the owner's risk. ParkTrooper LLC, to the fullest extent permitted by Texas law, is not liable for:

• Theft of or from any vehicle parked in our facilities
• Vandalism, damage, or destruction of any vehicle
• Weather-related damage including hail, flood, wind, or lightning
• Personal property left inside vehicles
• Acts of third parties

Our total liability to you for any claim arising from use of our services is limited to the amount you paid for parking in the month in which the incident occurred. This limitation does not apply to claims arising from ParkTrooper's gross negligence or willful misconduct.

6. Vehicle Damage Claims

If you believe your vehicle was damaged while in our care, you must:

• Report the damage to ParkTrooper in writing at support@parktrooper.com within 24 hours of discovery
• Document the damage with photographs taken at the facility before moving the vehicle
• Cooperate with any investigation ParkTrooper or its insurer conducts

Claims reported after 24 hours or without contemporaneous documentation may not be honored.

7. Acceptable Use of Website

You may use parktrooper.com to learn about our services, submit parking applications, and contact us. You agree not to:

• Use the site for any unlawful purpose
• Submit false or misleading information in any form
• Attempt to gain unauthorized access to our systems
• Scrape, copy, or redistribute our website content without written permission

8. Intellectual Property

All content on parktrooper.com — including text, graphics, logos, and the ParkTrooper name and shield mark — is the property of ParkTrooper LLC and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent.

9. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising from these Terms or use of our services shall be resolved in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction in those courts.

Before initiating legal proceedings, we encourage you to contact us at support@parktrooper.com to resolve any dispute informally. We will attempt to resolve any complaint within 30 days of receipt.

10. Disclaimer of Warranties

Our services and website are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Changes to These Terms

We may update these Terms from time to time. Changes will be reflected by updating the "Last updated" date above. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify active monthly parking customers by email.
